Terms of Service — Monika AI

1. Acceptance of Terms

By accessing or using Monika AI ("the Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you may not use the Service.

We may update these Terms from time to time. When we make material changes, we will require you to re-accept the updated Terms upon your next login. Your continued use of the Service after re-acceptance constitutes agreement to the revised Terms.

2. Eligibility

You must be at least 13 years of age to use Monika AI. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service. By creating an account, you represent and warrant that you meet these requirements.

3. Account Responsibility

You are responsible for maintaining the security of your account credentials and login sessions.
You are responsible for all activity that occurs under your account.
You must promptly revoke any sessions you do not recognize (Settings → Devices).
You may not share your account with others or create multiple accounts to circumvent usage limits.

4. Acceptable Use

You agree to use Monika AI only for lawful purposes. You may not:

Attempt to extract, reverse-engineer, or circumvent the AI model's safety guidelines or system instructions.
Use the Service to generate content that is illegal, harassing, threatening, sexually exploitative of minors, or that promotes violence or discrimination.
Attempt to gain unauthorized access to other users' accounts, data, or sessions.
Deliberately overload the Service by automated scripting, scraping, or flooding requests beyond normal human usage.
Use the Service to send spam, phishing, or malware through any feature (reminders, notifications, etc.).
Circumvent rate limits, authentication controls, or other security mechanisms.
Upload files that contain malware, viruses, or malicious payloads.

5. AI-Generated Content

Monika AI is an entertainment and companion chatbot, not a licensed professional. Responses generated by the AI:

Do not constitute medical, legal, financial, psychological, or any other professional advice.
May contain inaccuracies, hallucinations, or outdated information.
Should not be relied upon for critical decision-making.
Are generated by the Google Gemini language model and reflect statistical patterns in training data, not genuine understanding or consciousness.

You use AI-generated content at your own risk. If you are experiencing a mental health crisis, please contact a qualified professional or your local emergency services.

6. Intellectual Property

Your content — You retain ownership of the messages, memories, and files you submit to the Service. By using the Service, you grant us a limited license to process your content as necessary to provide and improve the Service.
AI-generated content — Responses generated by the AI are produced algorithmically and may not be eligible for copyright protection in all jurisdictions. You may use them for personal purposes.
Service materials — The Monika AI name, logos, UI design, and source code are the property of the project contributors and are released under the project's open-source license. You may not use our trademarks without permission.

7. Service Availability

We strive to keep Monika AI available, but we do not guarantee uninterrupted or error-free service. The Service may be temporarily unavailable due to:

Scheduled or emergency maintenance.
API rate limits or quota exhaustion on upstream providers (Google Gemini).
Infrastructure outages beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

8. Usage Limits

To ensure fair access for all users, the Service enforces daily limits on messages, image processing, and API requests. These limits may change without prior notice. Attempting to circumvent these limits is a violation of these Terms.

9. Termination

By you — You may delete your account at any time from Settings → Privacy → "Delete my account and all data." This permanently removes all your data and is irreversible.
By us — We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. Suspended accounts lose access to the Service but data may be retained for a reasonable period for legal compliance.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
We are not responsible for the accuracy, completeness, or usefulness of any AI-generated content.
Our total liability for any claim related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim (which is zero for a free service).

11. Indemnification

You agree to indemnify and hold harmless Monika AI, its contributors, and its operators from any claims, losses, or damages (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

12. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts in India.
